This week, the Cape Charles Wetlands and Dune Board investigated an alleged violation of the Chesapeake Bay Act at Bay Creek locations 104 & 111 Creekside Lane.
The Wetlands board ruled that there were not any violations done on the wetland but, there were Resource Protection Area (RPA) violations that Katie Nunez, Interim Zoning Administrator/Planner, would be pursuing.
The original complaint alleges the property owners violated the Wetlands Act and the Chesapeake Bay Preservation Act by clearcutting two lots located in the Bay Creek Development at the waterside edge.
No permits were applied to remove any trees or other vegetation. Katie H. Nunez, Interim Planning/Zoning Administrator has stated that she believes both lots are in violation of the Chesapeake Bay Preservation Overlay Ordinance and that 111 Creekside Lane is in violation of the Wetlands Act.
