Planning Commission approves draft language setting minimum square footage for dwellings

At last month’s town council meeting, Planning staff brought  proposed draft text amendments which set the minimum square footage for dwelling units in the Residential-1 zoning district to the Town Council as an informational agenda item. Council inquired about Bay Avenue-specific discussion by the Planning Commission, and staff responded that such properties were considered. A Bay Avenue property owner also submitted public comments and spoke on the public record about the requirements.

The Planning Commission has been working on a proposed draft text amendment to set a maximum square footage for dwelling units in the Residential-1 zoning district. According to the staff report, “Such a maximum would serve as both a cap on residential dwelling size, and as the mate for the current zoning ordinance language establishing the minimum square footage at nine hundred and sixty (960).”

The specific section reads as follows: Article III, Section 3.2.F.2 The minimum dwelling unit size shall be 960 square feet excluding garages, porches, patios, etc.

At their January 3, 2018 regular meeting, the Planning Commission approved the following language, and voted to send it to the Town Council: The minimum dwelling unit size shall be 960 square feet and the maximum dwelling unit size shall be 4,500 square feet on any lot or contiguous assemblage of lots under common ownership. Specific dwelling unit square footage relative to the square footage of any lot or contiguous assemblage of lots under common ownership shall be a. Lots or contiguous assemblage of lots under common ownership up to 5,600 square feet dwelling units shall be a minimum of 960 and a maximum of 2,400 square feet b. Lots or contiguous assemblage of lots under common ownership of 5,601 to 8,400 square feet dwelling units shall be a minimum of 960 and a maximum of 3,000 square feet c. Lots or contiguous assemblage of lots under common ownership above 8,400 square feet dwelling units shall be a minimum of 960 and a maximum of 4,500 square feet Patios, porches, decks, attached garages, and detached accessory use buildings shall not be included in calculating the dwelling unit square footage.

At Tuesday’s Planning Commission meeting, the Commission approved as submitted the proposed draft text amendment language setting maximum square foot area size for residential dwellings in the Residential – 1 district.

The Commission set a public hearing on this for the April 16, 2018 meeting.
