VDOT Route 642 Right-of-Entry Agreement

One of the top priorities, and one of the most observed road projects in the state is new VDOT Route 642, which will create a more streamlined access in and out of Bayshore Concrete. It will also create safety improvements and enhance access to the Cape Charles Harbor. The roadway will consist of two 12’ lanes and 8’ width shoulders with 4’ being paved, which will accommodate bicycles and pedestrians. Thursday, Council approved the Ordinance authorizing the town manager to execute the Right-of-Entry Agreement for the benefit of the Virginia Department of Transportation
(VDOT). This Right-of-Entry grants to VDOT and to its employees, agents, contractors or assigns the right to enter upon portions of the land encumbered by the Town’s drainage easement for the purpose of completing the Project.

From staff report, “Cape Charles owns a drainage easement over several parcels of property on the project pursuant to Quitclaim Deed of Easement recorded among the land records of Northampton County, Virginia in Deed Book 227, at page 778 (the “Quitclaim Deed”), upon which VDOT must enter in order to complete the project. This Right-of-Entry grants to VDOT and to its employees, agents, contractors or assigns the right to enter upon portions of the land encumbered by the Town’s drainage easement for the purpose of completing the Project.”
