The Cape Charles Town Council is moving closer to adopting a formal ordinance regulating mobile food and beverage vendors as town officials respond to a sharp increase in food trucks and other temporary vendors operating throughout the community.
Town staff presented the proposed Mobile Food and/or Beverage Vending Unit Ordinance during recent discussions with Council, describing the measure as an effort to create a standardized regulatory framework governing how mobile vendors operate in Cape Charles.
Officials said the number of mobile food vendors has grown noticeably over the past four years, particularly along Bay Avenue near the beachfront during the summer season and at festivals and special events held throughout the year.
According to town documents, staff from the Finance Office, Town Manager’s Office, and Planning and Zoning Department have spent much of 2026 reviewing existing conditions, identifying gaps in current regulations, and determining how mobile vendors fit within the town’s broader tourism and business economy.
The proposed ordinance would establish clearer rules defining acceptable types of mobile food and beverage units, required permits and approvals, and operational procedures for vendors conducting business within town limits.
Town Council previously reviewed an earlier draft of the ordinance during its April 9 public hearing and regular meeting. During that session, council members requested several language revisions and clarifications. Staff said those requested changes have now been incorporated into the updated draft ordinance presented for further review.
The proposal remains in the review stage. Staff has recommended that Council either provide additional direction on revisions or adopt Resolution of Intent 20260521, which would formally refer the ordinance to the Cape Charles Planning Commission for public hearing and further evaluation before final adoption consideration.
Town officials say the ordinance is intended to provide consistency and clarity for vendors, residents, event organizers, and existing brick-and-mortar businesses as Cape Charles continues to experience growth in tourism and seasonal activity.
