  1. When a utility company such as Virginia Power installs its own power lines (paid for by the developer ) and provides the service, the power company is responsible for all repairs and “ upgrades “.

    In the case of the Bay Creek subdivisions the developer installed the water and sewer lines (and pump stations) and transferred the ownership of the utilities to the Town of Cape Charles via WHAT ? I didn’t recall any transfer documents or public disclosure of any filed certificates of substantial completion.

    Once the Town sells the water and sewer treatment plants (and water tower), who owns, maintains and repairs all of the water and sewer lines ? Does the Town transfer the ownership of the utility easements ?

    Foster spent thousands of dollars repairing the old water and sewer lines in the Town in order to recapture the lost capacity of the below quality treatment plants. This became part of the “reserve” capacity that Foster was claiming. Wouldn’t Panek know?

    I wonder if Foster received payment for the repairs ?

    Who is due those moneys for those repaired and replaced utility lines, which the Town used in order to submit utility bills to its customer, whether in use or not?
