The Cape Charles Wetlands and Dune will investigate an alleged violation of the Chesapeake Bay Act at Bay Creek locations 104 & 111 Creekside Lane. The properties are owned by Anthony and Susan Cataldo, Robert and Cheryl Nelson.
The complaint alleges the property owners violated the Wetlands Act and the Chesapeake Bay Preservation Act by clearcutting two lots located in the Bay Creek Development at the waterside edge.
No permits were applied to remove any trees or other vegetation. Katie H. Nunez, Interim Planning/Zoning Administrator has stated that she believes both lots are in violation of the Chesapeake Bay Preservation Overlay Ordinance and that 111 Creekside Lane is in violation of the Wetlands Act.
This topic will be taken up by the board on September 8th at 3:00, at the Cape Charles Civic Center– 500 Tazewell Avenue.

Funny how the town is going to investigate 2 individual property owners but nothing is said when Preserve Communities / Bay Creek completely clear cuts the entire waterfront side of “PLANTATION” Point. Is it because a town council member who is also on The Bay Creek board lives in “PLANTATION” point?
Also hearing the town is going to now allow homes to be built in Bay Creek at a 50 ft bay set backs. Isn’t it supposed to be a 100 ft bay set back? What about the poor Tiger Beatles?
If you control Bay Creek’s board and town council I guess you can do anything you want!
