Automated license plate readers are becoming a common police tool across Virginia and the nation. Supporters say they help solve crimes and find missing people. Critics say they are quietly creating a powerful surveillance network that records the movements of millions of innocent motorists.
Automated license plate reader cameras are increasingly appearing along American roads, at neighborhood entrances and near major intersections. Small, relatively unobtrusive and often mounted on poles, the cameras can photograph passing vehicles, identify license plates and record when and where a vehicle was observed.
Among the largest providers is Flock Safety, an Atlanta-based technology company whose license plate reader systems are used by thousands of law enforcement agencies and communities.
To police departments, the attraction is straightforward: A camera can potentially spot a stolen vehicle, locate a car connected to a serious crime or provide investigators with a lead that otherwise might take days or weeks to develop.
To privacy advocates, however, the same capability raises a different question.
What happens when a system designed to find criminals also records the movements of nearly everyone else?
That tension — between public safety and personal privacy — has turned automated license plate readers, commonly called ALPRs, into one of the most significant debates surrounding modern policing.
Unlike traditional traffic cameras designed primarily to issue speeding or red-light citations, Flock-style ALPR cameras are generally investigative tools.
As vehicles pass a camera, the system can record the license plate along with information such as the date, time and location of the observation and characteristics of the vehicle.
Investigators can then search the database.
Suppose police receive a report that a burglary suspect fled in a white pickup truck. Even without a complete license plate number, investigators may be able to search vehicle characteristics and determine whether a matching truck passed cameras near the crime scene.
The system can also generate alerts when a camera detects a license plate associated with a stolen vehicle, wanted person or certain law-enforcement databases.
Flock argues that these observations are fundamentally different from GPS tracking because each camera records a vehicle only when it passes a particular location.

The company says its technology supported more than 1 million criminal investigations or incidents during 2025 and helped locate more than 10,000 missing people. Flock also reports that approximately one in five cleared cases in jurisdictions responding to its survey involved its technology.
Those figures are supplied by Flock and should be understood as company-reported statistics rather than an independent nationwide assessment of ALPR effectiveness.
Still, there is little dispute that license plate readers can provide useful investigative evidence.
For law enforcement, perhaps the strongest argument for ALPR technology is speed.
Traditional investigations can require officers to interview witnesses, review security-camera footage from multiple businesses or canvass neighborhoods trying to determine which vehicles were present.
An ALPR search can sometimes provide that information within minutes.
A vehicle connected to a kidnapping, armed robbery or missing child could potentially be identified as it passes a camera. Investigators looking backward can determine whether a suspect vehicle traveled through a particular location around the time of a crime.
There is another potential benefit: objectivity.
A camera does not need to remember whether a vehicle was blue or black, and it does not become distracted during a shift. Properly functioning systems create records that investigators can examine later.
Supporters also argue that license plates are deliberately displayed in public. Drivers traveling on public roads generally have no expectation that their plates will remain unseen.
Flock takes that argument a step further, saying its cameras make discrete observations at fixed locations rather than continuously tracking individuals.
For a police department with limited staffing, particularly in a smaller community, that capability can be appealing. Technology can effectively watch an intersection around the clock without requiring an officer to sit there.
But critics say that comparison overlooks something fundamental.
A police officer might observe hundreds of license plates during a shift. A network of computers can potentially remember millions of them — and search those observations almost instantaneously.
When Observation Becomes Surveillance
That distinction sits at the heart of the privacy debate.
Seeing a vehicle on a public street is one thing.
Creating a searchable database showing where thousands or millions of vehicles have traveled is another.
The American Civil Liberties Union argues that widespread ALPR networks can reveal intimate patterns about people’s lives even when individual cameras collect information only from public roads.
Repeated observations could potentially indicate where someone lives, works, worships, receives medical treatment or spends personal time.
The overwhelming majority of vehicles photographed by these systems are not associated with criminal activity.
That means the central privacy question is not simply whether police should be able to look for a stolen vehicle.
It is whether information about everyone else’s vehicles should first be collected and stored so that police can conduct that search later.
Privacy advocates often describe this as the difference between targeted surveillance and mass surveillance.
In traditional targeted surveillance, police begin with a suspect and then gather information.
With a large ALPR network, information can be gathered first and investigators can decide later whose movements they want to examine.
The Network Effect
A single camera at one intersection reveals relatively little.
Hundreds or thousands of interconnected cameras can reveal considerably more.
This is sometimes called the “network effect.”
If agencies share access to their ALPR systems, investigators may be able to search for vehicles far outside their own jurisdiction.
That can be extremely useful when pursuing a kidnapping suspect or stolen vehicle across county or state lines.
It can also dramatically increase the surveillance capability of each participating police department.
Recent reporting has intensified concerns about how broadly some Flock information has been shared and whether local governments always understood the reach of those arrangements.
Those concerns have prompted some communities around the country to reconsider or terminate their ALPR programs, while others have responded by strengthening auditing and access restrictions.
Flock has also announced changes intended to address the criticism. In August, the company said it was reducing its recommended default retention period from 30 days to seven days, requiring stronger auditing and case codes for searches, expanding misuse detection and requiring multifactor authentication.
The company says customers own and control their data and determine how it may be shared, subject to applicable law.
Critics contend that technological safeguards and company policies are not substitutes for enforceable laws and independent government oversight.
Virginia Has Put Limits on ALPR Use
For Virginia communities, the debate is no longer occurring in a regulatory vacuum.
Virginia enacted legislation governing law-enforcement use of automatic license plate recognition systems.
The law limits the purposes for which police may search ALPR information. Permitted uses include criminal investigations where there is reasonable suspicion that a crime occurred, investigations involving missing or endangered people and alerts involving matters such as outstanding warrants, stolen vehicles and human trafficking.
Virginia law also requires ALPR system data generally to be destroyed after 21 days unless it becomes part of an ongoing investigation, prosecution or civil matter.
The statute requires audit trails recording who searched the system, when the search occurred, the purpose of the search and associated case information.
Virginia also restricts how the information may be shared and makes certain intentional misuse a Class 1 misdemeanor.
Before stopping a vehicle solely because of an ALPR notification, an officer generally must independently develop reasonable suspicion or confirm that the vehicle matches the information that generated the alert.
Those safeguards are important because ALPR systems are not infallible.
No automated identification system should be treated as unquestionable evidence.
A license plate can be obscured, damaged or dirty. Lighting and weather conditions can interfere with images. Characters can be confused. A legitimate plate can be stolen or duplicated.
And even when a camera reads a plate perfectly, that does not establish who is driving the vehicle.
For that reason, an ALPR alert should generally be treated as an investigative lead rather than proof that a crime has occurred.
The consequences of getting that distinction wrong can be serious.
A mistaken plate match combined with insufficient human verification can transform an automated alert into an unnecessary traffic stop — potentially involving an entirely innocent driver.
The technology may therefore be only as responsible as the policies governing the officers who use it.
Another concern has little to do with the cameras themselves.
It involves the people authorized to search them.
Any database containing sensitive information carries the possibility of misuse.
An officer could theoretically search for the vehicle of an acquaintance, former spouse, political opponent, journalist or other person without a legitimate investigative reason.
Cases involving alleged improper ALPR searches have heightened that concern nationally.
The answer offered by law enforcement agencies and technology providers is auditing: Every search should be associated with an individual user and legitimate investigative purpose so improper searches can be discovered.
Richmond provides one Virginia example of that oversight process. The Richmond Police Department says it conducts monthly audits of ALPR use. A first-quarter 2026 audit discovered one policy violation involving a sergeant responding to an FBI request connected with a homicide investigation. The department publicly reported the incident and said the audit demonstrated why oversight is necessary.
That example illustrates both sides of the argument.
Critics can point to the violation as evidence that misuse or improper access can occur.
Supporters can point to its discovery as evidence that auditing works.
A Constitutional Question Still Developing
There is also a larger legal question: At what point does widespread collection of vehicle-location information constitute a search under the Fourth Amendment?
Courts have wrestled with the distinction between observations occurring in public and technology capable of assembling those observations into a detailed record of someone’s movements.
Flock maintains that courts have repeatedly found limited ALPR deployments constitutional because cameras create individual observations rather than continuous GPS-style tracking.
Civil-liberties organizations argue that the scale of modern interconnected ALPR networks changes the constitutional analysis.
Virginia is part of that debate.
A legal challenge involving Norfolk’s use of Flock cameras has raised questions about whether a sufficiently dense network of ALPR cameras can reveal enough information about a person’s movements to implicate Fourth Amendment protections.
The issue is likely to continue developing as courts confront surveillance capabilities that would have been technologically impossible only a generation ago.
The debate is sometimes framed as a simple choice between supporting law enforcement and protecting privacy.
It does not necessarily have to be.
A community could decide that ALPR technology provides legitimate public-safety benefits while simultaneously imposing strict restrictions on its use.
Among the questions elected officials and residents can reasonably ask are:
Who is permitted to search the system?
What crimes justify a search?
Must every search be connected to a case number?
How long is information retained?
Which other agencies can access local camera data?
Can federal agencies obtain it?
Are searches automatically audited?
Are audit results available to the public?
What happens when an employee misuses the system?
How frequently are cameras producing incorrect matches?
Can residents see where cameras are located and how frequently they are being used?
And perhaps most importantly: Who ultimately decides when the technology’s capabilities expand?
Those are governance questions rather than purely technological ones.
Trading Safety and Liberty
There is a compelling argument for giving police effective tools to find an abducted child, locate a stolen vehicle or identify someone responsible for a violent crime.
There is also a compelling argument that Americans should not have their movements routinely cataloged merely because the technology makes doing so inexpensive and convenient.
Both concerns can be true simultaneously.
Flock cameras illustrate a broader challenge communities will increasingly face as artificial intelligence, cameras, databases and inexpensive computing become embedded in public infrastructure.
Technology can provide government capabilities that previous generations could scarcely imagine.
The question is not simply whether those capabilities work.
It is what limits communities are willing to place on them before they become commonplace.
For residents considering automated license plate readers, perhaps the most important discussion therefore comes before the cameras are installed — when the community still has an opportunity to decide not only what the technology can do, but what government should be permitted to do with it.
