The following entry is from a Cape Charles resident that resides in Bay Creek. While the issue has occurred at Bay Creek, it speaks to lots and homes all through Cape Charles.
This is possibly going to be an issue here at our home at Bay Creek. A man bought the lot directly the North of us on Lot 5 The Colony on the Bay Front. We live on Lot 6. He purchased the lot as a “Sunset Blvd. Cape Charles LLC” to build a rental property only. This is 10 feet away from our home. This new owner of Lot 5 says he is doing a rental property only. We have experienced this prior and it is a nightmare. People screaming and drunk at 4:30 AM. They set off illegal fireworks last New Years Eve to the horror of our German Shepherd and us from the “beach” directly over our house and the police had to be called . That is only a small slice of what has happened here. We were in Kings Bay prior to this home and this happened to us there in 2003. This place was meant as a Residential Community. Now it will be turned commercial with these people who also own 7 bedroom home in the Outer Banks and have the same intention for here. Is were any help for this madness?
A property owner clarified the current ordinance:
Yes, Zoning and Subdivision Ordinance is for Single Family Residence, not a Commercial enterprise. Offends the Bay Creek at Cape Charles Community Association (the P.O.A.), the PUD and the Town Ordinances, as well as the Annexation Agreement allowing for 3,000 housing Units to be permitted (in the future) as single-family residences or condominium associations of housing Units within the 3,000 total units to be permitted. Real Estate taxes in The Colony are based on single-family residences, not commercial enterprises. The Villas in the Marina District are not within the PUD classification for Accawmacke Plantation (Bay Creek’s Declaration). Oppose the business application. Move to assert with a cease and desist order now. Or perhaps, you could open a bingo parlor with overnight guests, or a ‘public purpose’ property.
You could always move. If you didn’t want neighbors, you should have purchased adjoining lots.
