On August 19th, the Department of Environmental Quality hit the town’s wastewater treatment plant with a series of violations. A Notice of Violation letter was sent to reflect on any possible administrative or judicial enforcement actions. The letter stated that the DEQ has reason to believe that the “Town of Cape Charles may be in violation of the State Water Control Law and Regulations at the Cape Charles Wastewater Treatment Plant”.
In all there were nine violations noted, most dealing with equipment malfunctions.
Town Manager Hozey has responded to the DEQ’s Notice of Violation, addressing the nine issues, and offering intended remediation. Most of the issues revolve around the town’s inability to get replacement parts for the machinery.

It appears that the WWTP management has totally “broken down”. Equipment breaks, but non compliance of operating competency and failure to keep required logs??? Maybe the lack of operating competency is directly connected to equipment failures.
Mr Hozey, where are you?? Those fines can be really tough as your WWTP deteriorates
the water quality around CC. Maybe this is just more of “Move on, nothing to see here” attitude for CC residents.
