CAPE CHARLES, Va. — In a significant defeat for the town’s zoning office, the Cape Charles Board of Zoning Appeals approved the appeals of all applicants during its regular meeting on October 8, 2024, overturning decisions made by the Planning and Zoning Administrator.
Paul Chandler’s Appeal
The first appeal came from Paul Chandler, who contested a zoning violation issued on May 31, 2024, concerning his property at 204 Bay Avenue. The violation cited several sections of the Cape Charles Zoning Ordinance (CCZO), including Sections 2.4.2 (A)(1), 2.4.3(1), 8.16, and 8.17. The violation related to gutter work that Chandler performed without securing the necessary Certificate of Appropriateness, despite being informed that he could obtain the certificate administratively. Chandler’s appeal was approved by the board, effectively negating the zoning violation.
Frank Wendell Jr.’s Appeal
The board also approved an appeal from Frank Wendell Jr., who challenged a violation dated July 8, 2024. Wendell had been cited for parking a vehicle on an undeveloped lot in the 500 block of Madison Avenue (Tax Map #83A3-1-273), in violation of CCZO Sections 3.2 and 2.9, which govern the use of lots in the Residential-1 (R-1) Zoning District. Wendell argued that the zoning violations, which argued that his private property where he parked a vehicle was not a commercial parking lot, and his vehicle was not for commercial use. The board sided with him, dismissing the violations.
Robert and Kathie Naylor’s Variance Request
In the final case, the board granted a variance to Robert and Kathie Naylor for their property at 113 William Scott Lane, located in the Bay Creek Development. The Naylors sought relief from CCZO Section 3.12, which regulates setbacks in Planned Unit Developments (PUD). The board approved their request for a side yard setback of 3.1 feet, allowing them to proceed with their plans.
The decisions mark a notable setback for the town’s zoning office, as all contested rulings were overturned. These cases highlight ongoing tensions over zoning regulations in Cape Charles, particularly in the town’s historic and residential districts.
