The Board of Zoning Appeals met Monday and approved an application for variance from the rear yard setback requirement at 114 Pine Street. Due to the non-conforming size of the lot and the orientation of the existing building on that lot, the applicant was seeking relief from a strict application of the rear yard setback in a residential district requirement.
The proposed rear addition measures twelve (12) feet deep by twenty-five (25) feet in width. After approval, the rear yard is now a depth of slightly more than nine and one-half (9.5) feet. This distance accounts for eleven and seven-eighths (11.875%) percent of the lot depth.
The vote to approve was unanimous, and the Board expressed interest in a future work session to review certain zoning ordinance sections for clarity and general application across the variety of lot sizes and building orientations.
The applicant approached staff about an addition to the existing residential building, three hundred (300) square feet in area, and was informed that such an addition could not be allowed by right due to depth of the lot upon which the building is located not meeting the required rear yard setback.
The lot is located at the corner of Pine Street and Randolph Avenue and is eighty (80) feet in depth. The total area is approximately four-thousand (4,000) square feet at the northeast corner of Pine Street and Randolph Avenue.
