WASHINGTON (AP) — Special counsel says Biden came across to investigators as ‘well-meaning, elderly man with a poor memory.’
Key parts of the report: Mr. Biden wrote his 2007 and 2017 memoirs with the help of a ghostwriter. In a recorded conversation with his ghostwriter in February 2017, about a month after he left office, Mr. Biden said, while referencing his 2009 Thanksgiving memo, that he had “just found all the classified stuff downstairs.” Several defenses are likely to create reasonable doubt as to such charges. For example, Mr. Biden could have found the classified Afghanistan documents at his Virginia home in 2017 and then forgotten about them soon after. This could convince some reasonable jurors that he did not retain them willfully.
The place where the Afghanistan documents were eventually found in Mr. Biden’s Delaware garage-in a badly damaged box surrounded by household detritus-suggests the documents might have been forgotten. In addition. Mr. Biden’s memory was significantly limited, both during his recorded interviews with the ghostwriter in 2017, and in his interview with our office in 2023.
And his cooperation with our investigation, including by reporting to the government that the Afghanistan documents were in his Delaware garage, will likely convince some jurors that he made an innocent mistake, rather than acting willfully-that is, with intent to break the law-as the statute requires. Mr. Biden should have known that by reading his unfiltered notes about classified meetings in the Situation Room, he risked sharing classified information with his ghostwriter.
However, the evidence does not show that when Mr. Biden shared the specific passages with his ghostwriter, Mr. Biden knew the passages were classified and intended to share classified information. files. \Ve considered whether to charge the ghostwriter with obstruction of justice, but we believe the evidence would be insufficient to obtain a conviction and therefore declined to prosecute him.
We have also considered that, at trial, Mr. Biden would likely present himself to a jury, as he did during our interview of him, as a sympathetic, well-meaning, elderly man with a poor memory. Based on our direct interactions with and observations of him, he is someone for whom many jurors will want to identify reasonable doubt.
As he told his ghostwriter during a recorded interview, the same staff who arranged to secure his classified notecards “didn’t even know” he had retained possession of his classified notebooks.” Mr. Eiden explained that, despite his staffs views to the contrary, he did not think he was required to turn in his notecards to the National Archive.
Why does he blame his staff? Asked about reports that former President Trump had kept classified documents at his own home, Mr. Biden wondered how “anyone could be that irresponsible” and voiced concern about “[w]hat data was in there that may compromise sources and methods.” During the interview, Mr. Biden was emphatic, declaring that his notebooks are “my property” and that “every president before me has done the same thing,” that is, kept handwritten classified materials after leaving office” But, Biden was not president…Trump was.
Special Counsel Hur found both: (1) “faulty memory”; and (2) “diminished faculties.” That second finding is hugely significant. It is a finding the President not only has memory issues, but also has cognitive impairment. No surprise the White House strenuously objected to this language.
Special counsel: the President is a criminal, but mentally unfit to stand trial. Quite a pitch for Biden to take to voters.
DOJ: “Evidence supports the inference that when Mr. Biden said in 2017 that he had ‘just found all the classified stuff downstairs’ in Virginia, he was referring to the same marked classified documents about Afghanistan that FBI agents found in 2022 in his Delaware garage.”
Special Counsel Robert Hur: “Our investigation uncovered evidence that President Biden willfully retained and disclosed classified materials after his vice presidency when he was a private citizen.”
Biden blames his staff for storing classified documents in his home, office, and garage for five decades: “I take responsibility for not having seen exactly what my staff would doing!”
What staffers? If they did it how did they get the docs? From his senate years as well? Did they have clearance? Are they also too old and infirm to stand trial?

The phrase “down a rabbit hole” is a metaphor for something that transports someone into a troublingly surreal state or situation, and such is the case right here, where Joe Biden is mentally unfit to be tried as a criminal, but still is allowed to sit in the oval office.
This DOJ report should, in a sane and rational world, which this most certainly is not, be sufficient grounds for Joe’s removal pursuant to the 25th amendment.
As one dude succinctly remarked, for the sake of global security, Joe Biden needs to be retired from public office, enough is enough, he can no longer be trusted to run a bath – let alone the free world!
