The Cape Charles Wetlands and Dune will investigate an alleged violation of the Chesapeake Bay Act at Bay Creek locations 104 & 111 Creekside Lane. The properties are owned by Anthony and Susan Cataldo, Robert and Cheryl Nelson.
The complaint alleges the property owners violated the Wetlands Act and the Chesapeake Bay Preservation Act by clearcutting two lots located in the Bay Creek Development at the waterside edge.
No permits were applied to remove any trees or other vegetation. Katie H. Nunez, Interim Planning/Zoning Administrator has stated that she believes both lots are in violation of the Chesapeake Bay Preservation Overlay Ordinance and that 111 Creekside Lane is in violation of the Wetlands Act.
This topic will be taken up by the board on September 8th at 3:00, at the Cape Charles Civic Center– 500 Tazewell Avenue.
