In a significant development for Cape Charles, Virginia American Water has finalized the sale of utilities, marking a pivotal transition in the region’s infrastructure landscape. With aspects of the original Annexation Agreement between the Town and Brown&Root (which led to the creation of what we now call Bay Creek) still looming, the Planning Department is embarking on the creation of a comprehensive database encompassing all properties owned by Bay Creek Development, LLC; Bay Creek South, LLC; and Bay Creek Resort LLC.
This database initiative, initiated in light of the sale of the utility system on April 24, 2024, holds critical importance in the context of tracking the requirements outlined in Amendment #3 to the Agreement between Brown & Root and the Town. Specifically, this amendment pertains to Annexation and mandates the collection of a $3,000 fee per lot upon sale by the developer for the Town.
By cataloging properties owned by the aforementioned entities as of the date of the utility system sale, officials aim to streamline the monitoring and enforcement of the stipulated fee collection process.
doesn’t the original annexation agreement require the developer [originally Brown and Root] to fund the expansion of the wastewater treatment facility and the water facility to cover the increase needs of the development.? and doesn’t that obligation convey to all the subsequent owners of the Accwmacke Plantation PUD
